Question of Palestine<\/strong><\/p><\/div>\n A<\/strong><\/p><\/div>\n \t<\/span>The General Assembly<\/i>,<\/p><\/div>\n <\/p>\n \t<\/span><\/span>Recalling and reaffirming<\/i><\/span> its resolutions <\/span>181 (II)<\/a> of 29 November 1947, <\/span>194 (III)<\/a> of 11 December 1948, <\/span>3236 (XXIX)<\/a> of 22 November 1974, <\/span>3375 (XXX)<\/a> and <\/span>3376 (XXX)<\/a> of 10 November 1975, <\/span>31\/20 <\/a>of 24 November 1976, <\/span>32\/40 A and B <\/a>of 2 December 1977, <\/span>33\/28 A to C<\/a> of 7 December 1978, <\/span>34\/65 A to D<\/a> of 29 November and 12 December 1979 and <\/span>ES-7\/2 <\/a>of 29 July 1980,<\/span><\/p><\/div>\n <\/p>\n \t<\/span>Having considered<\/i> the report of the Committee on the Exercise of the Inalienable Rights of the Palestinian People,<\/p><\/div>\n <\/p>\n \t<\/span>Having heard<\/i> the statement of the Palestine Liberation Organization, the representative of the Palestinian people,<\/p><\/div>\n <\/p>\n \t<\/span>1.\t<\/span><\/span>Expresses its grave concern<\/i><\/span> that no just solution to the problem of Palestine has been achieved and this problem therefore continues to aggravate the Middle East conflict, of which it is the core, and to endanger international peace and security, and that <\/span>Security Council resolution 242 (1967<\/a>) of 22 November 1967 does not provide for the future and for the inalienable rights of the Palestinian people the attainment of which is a condition sine qua non for a just solution of the question of Palestine;<\/span><\/p><\/div>\n <\/p>\n \t<\/span>2.\t<\/span>Reaffirms<\/i> that a just and lasting peace in the Middle East cannot be established without the achievement, inter alia<\/i>, of a just solution of the problem of Palestine on the basis of the attainment of the inalienable rights of the Palestinian people, including the right of return and the right to self-determination, national independence and sovereignty in Palestine, in accordance with the Charter of the United Nations and the principles of international law;<\/p><\/div>\n <\/p>\n \t<\/span>3.\t<\/span><\/span>Stresses<\/i><\/span> the basic principle that the future of the Palestinian people cannot be discussed in their absence and, therefore, calls once more for the invitation of the Palestine Liberation Organization, the representative of the Palestinian people, to participate, on the basis of General Assembly resolution <\/span>3237 (XXIX)<\/a> of 22 November 1974, in all efforts, deliberations and conferences on the Middle East which are held under the auspices of the United Nations, on an equal footing with other parties;<\/span><\/p><\/div>\n <\/p>\n \t<\/span>4.\t<\/span>Endorses<\/i> the recommendations of the Committee on the Exercise of the Inalienable Rights of the Palestinian People contained in paragraphs 45 to 48 of its report and draws the attention of the Security Council to the need for urgent action thereon;<\/p><\/div>\n <\/p>\n \t<\/span>5.\t<\/span>Reaffirms<\/i> the inalienable right of the Palestinians to return to their homes and property in Palestine, from which they have been displaced and uprooted, and calls for their return;<\/p><\/div>\n <\/p>\n \t<\/span>6.\t<\/span>Reaffirms also<\/i> the inalienable rights in Palestine of the Palestinian people, including:<\/p><\/div>\n <\/p>\n \t<\/span>(a<\/i>)\t<\/span>The right to self-determination without external interference, and to national independence and sovereignty;<\/p><\/div>\n <\/p>\n \t<\/span>(b<\/i>)\t<\/span>The right to establish its own independent sovereign State;<\/p><\/div>\n <\/p>\n \t<\/span>7.\t<\/span>Strongly reaffirms<\/i> its repeated endorsement of the recommendations of the Committee on the Exercise of the Inalienable Rights of the Palestinian People, as contained in paragraphs 59 to 72 of its report on its thirty-first session, and as reproduced in the annex to the present resolution;<\/p><\/div>\n <\/p>\n \t<\/span>8.\t<\/span>Demands<\/i> the complete and unconditional withdrawal by Israel from all the Palestinian and other Arab territories occupied since June 1967, including Jerusalem, in conformity with the fundamental principle of the inadmissibility of the acquisition of territory by force;<\/p><\/div>\n <\/p>\n \t<\/span>9.\t<\/span>Demands<\/i> that Israel should fully comply with the provisions, in particular, of Security Council resolution 465 (1980) adopted unanimously on 1 March 1980;<\/p><\/div>\n <\/p>\n \t<\/span>10.\t<\/span><\/span>Further demands<\/i><\/span> that Israel should fully comply with all the resolutions of the United Nations relevant to the historic character of the Holy City of Jerusalem, in particular <\/span>Security Council resolutions 476 (1980)<\/a> of 30 June 1980 and <\/span>478 (1980)<\/a> of 20 August 1980, and rejects the declaration of Israel that Jerusalem is its capital;<\/span><\/p><\/div>\n <\/p>\n \t<\/span>11.\t<\/span>Expresses its opposition<\/i> to all policies and plans aimed at the resettlement of the Palestinians outside their homeland;<\/p><\/div>\n <\/p>\n \t<\/span>12.\t<\/span><\/span>Condemns<\/i><\/span> Israel for its non-compliance with the provisions of General Assembly resolution ES-7\/2 and Security Council resolutions <\/span>465 (1980) <\/a>and <\/span>478 (1980)<\/a> and other relevant resolutions of the United Nations;<\/span><\/p><\/div>\n <\/p>\n \t<\/span>13.\t<\/span>Requests<\/i> the Security Council to convene in order to consider the situation and the adoption of effective measures under Chapter VII of the Charter;<\/p><\/div>\n <\/p>\n \t<\/span>14.\t<\/span>Decides<\/i> to include in the provisional agenda of its thirty-sixth session the item entitled "Question of Palestine".<\/p><\/div>\n <\/p>\n \n <\/p>\n ANNEX<\/strong><\/p><\/div>\n <\/p>\n Recommendations of the Committee on the Exercise of the<\/strong><\/p><\/div>\n Inalienable Rights of the Palestinian People,<\/strong><\/p><\/div>\n endorsed by the General Assembly at its thirty-first session<\/strong><\/p><\/div>\n 1. BASIC CONSIDERATIONS AND GUIDELINES<\/p><\/div>\n <\/p>\n \t<\/span>59.\t<\/span>The question of Palestine is at the heart of the Middle East problem, and, consequently, the Committee stressed its belief that no solution in the Middle East can be envisaged which does not fully take into account the legitimate aspirations of the Palestinian people.<\/p><\/div>\n <\/p>\n \t<\/span>60.\t<\/span>The legitimate and inalienable rights of the Palestinian people to return to their homes and property and to achieve self-determination, national independence and sovereignty are endorsed by the Committee in the conviction that the full implementation of these rights will contribute decisively to a comprehensive and final settlement of the Middle East crisis.<\/p><\/div>\n <\/p>\n \t<\/span>61.\t<\/span>The participation of the Palestine Liberation Organization, the representative of the Palestinian people, on an equal footing with other parties, on the basis of General Assembly resolutions 3236 (XXIX) and 3375 (XXX) is indispensable in all efforts, deliberations and conferences on the Middle East which are held under the auspices of the United Nations.<\/p><\/div>\n <\/p>\n \t<\/span>62.\t<\/span>The Committee recalls the fundamental principle of the inadmissibility of the acquisition of territory by force and stresses the consequent obligation for complete and speedy evacuation of any territory so occupied.<\/p><\/div>\n <\/p>\n \t<\/span>63.\t<\/span>The Committee considers that it is the duty and the responsibility of all concerned to enable the Palestinians to exercise their inalienable rights.<\/p><\/div>\n <\/p>\n \t<\/span>64.\t<\/span>The Committee recommends an expanded and more influential role by the United Nations and its organs in promoting a just solution to the question of Palestine and in the implementation of such a solution. The Security Council, in particular, should take appropriate action to facilitate the exercise by the Palestinians of their right to return to their homes, lands and property. The Committee, furthermore, urges the Security Council to promote action towards a just solution, taking into account all the powers conferred on it by the Charter of the United Nations.<\/p><\/div>\n <\/p>\n \t<\/span>65.\t<\/span>It is with this perspective in view and on the basis of the numerous resolutions of the United Nations, after due consideration of all the facts, proposals and suggestions advanced in the course of its deliberations, that the Committee submits its recommendations on the modalities for the implementation of the exercise of the inalienable rights of the Palestinian people.<\/p><\/div>\n II. RIGHT OF RETURN<\/p><\/div>\n <\/p>\n \t<\/span>66.\t<\/span>The natural and inalienable right of Palestinians to return to their homes is recognized by resolution 194 (III), which the General Assembly has reaffirmed almost every year since its adoption. This right was also unanimously recognized by the Security Council in its resolution 237 (1967); the time for the urgent implementation of these resolutions is long overdue.<\/p><\/div>\n <\/p>\n \t<\/span>67.\t<\/span>Without prejudice to the right of all Palestinians to return to their homes, lands and property, the Committee considers that the programme of implementation of the exercise of this right may be carried out in two phases.<\/p><\/div>\n <\/p>\n Phase one<\/i><\/p><\/div>\n <\/p>\n \t<\/span>68.\t<\/span>The first phase involves the return to their homes of the Palestinians displaced as a result of the war of June 1967. The Committee recommends that:<\/p><\/div>\n <\/p>\n \t<\/span>(a<\/i>)\t<\/span>The Security Council should request the immediate implementation of its resolution 237 (1967) and that such implementation should not be related to any other condition;<\/p><\/div>\n <\/p>\n \t<\/span>(b<\/i>)\t<\/span>The resources of the International Committee of the Red Cross and\/or of the United Nations Relief and Works Agency for Palestine Refugees in the Near East, suitably financed and mandated, may be employed to assist in the solution of any logistical problems involved in the resettlement of those returning to their homes. These agencies could also assist, in co-operation with the host countries and the Palestine Liberation Organization, in the identification of the displaced Palestinians.<\/p><\/div>\n <\/p>\n Phase two<\/i><\/p><\/div>\n <\/p>\n \t<\/span>69.\t<\/span>The second phase deals with the return to their homes of the Palestinians displaced between 1948 and 1967. The Committee recommends that:<\/p><\/div>\n <\/p>\n \t<\/span>(a<\/i>)\t<\/span>While the first phase is being implemented, the United Nations in co-operation with the States directly involved, and the Palestine Liberation Organization as the interim representative of the Palestinian entity, should proceed to make the necessary arrangements to enable Palestinians displaced between 1948 and 1967 to exercise their right to return to their homes and property, in accordance with the relevant United Nations resolutions, particularly General Assembly resolution 194 (III);<\/p><\/div>\n <\/p>\n \t<\/span>(b<\/i>)\t<\/span>Palestinians not choosing to return to their homes should be paid just and equitable compensation as provided for in resolution 194 (III).<\/p><\/div>\n III. RIGHT TO SELF DETERMINATION, NATIONAL INDEPENDENCE AND SOVEREIGNTY<\/p><\/div>\n <\/p>\n \t<\/span>70.\t<\/span>The Palestinian people has the inherent right to self-determination, national independence and sovereignty in Palestine. The Committee considers that the evacuation of the territories occupied by force and in violation of the principles of the Charter and relevant resolutions of the United Nations is a condition sine qua non for the exercise by the Palestinian people of its inalienable rights in Palestine. The Committee considers, furthermore, that upon the return of the Palestinians to their homes and property and with the establishment of an independent Palestinian entity, the Palestinian people will be able to exercise its rights to self-determination and to decide its form of government without external interference.<\/p><\/div>\n <\/p>\n \t<\/span>71.\t<\/span>The Committee also feels that the United Nations has a historical duty and responsibility to render all assistance necessary to promote the economic development and prosperity of the Palestinian entity.<\/p><\/div>\n <\/p>\n \t<\/span>72.\t<\/span>To these ends, the Committee recommends that:<\/p><\/div>\n <\/p>\n \t<\/span>(a<\/i>)\t<\/span>A time-table should be established by the Security Council for the complete withdrawal by Israeli occupation forces from those areas occupied in 1967; such withdrawal should be completed no later than 1 June 1977,<\/p><\/div>\n <\/p>\n \t<\/span>(b<\/i>)\t<\/span>The Security Council may need to provide temporary peace-keeping forces in order to facilitate the process of withdrawal;<\/p><\/div>\n <\/p>\n \t<\/span>(c<\/i>)\t<\/span>Israel should be requested by the Security Council to desist from the establishment of new settlements and to withdraw during this period from settlements established since 1967 in the occupied territories; Arab property and all essential services in these areas should be maintained intact;<\/p><\/div>\n <\/p>\n \t<\/span>(d<\/i>)\t<\/span>Israel should also be requested to abide scrupulously by the provisions of the Geneva Convention relative to the Protection of Civilian Persons in Time of War, of 12 August 1949, and to declare, pending its speedy withdrawal from these territories, its recognition of the applicability of that Convention;<\/p><\/div>\n <\/p>\n \t<\/span>(e<\/i>)
\n<\/p><\/div>\n
